To avoid conflicts of interest and the perception of conflicts of interest, stakeholders or members of the public are discouraged from giving or offering any payments or gifts, entertainment or hospitality (“Gift, Entertainment or Hospitality” or “GEH”) to Yayasan Peneraju staff.

Yayasan Peneraju staff reserve the right to decline any GEH given or offered in order to avoid any perception of a conflict of interest with the relevant party.

Yayasan Peneraju adopts a zero-tolerance approach towards all forms of bribery and corruption. Accordingly, any form of corruption in the Company’s operations and daily activities is strictly prohibited.

Bribery and corruption may take any form of value, including money, goods, services, property, privileges, positions of employment, or special treatment.

Accordingly, Yayasan Peneraju staff and Business Associates shall not, whether directly or indirectly, offer, give, receive or solicit anything of value, in an attempt to unlawfully influence the decision or action of a person holding an entrusted position within the organisation, whether for the benefit of Yayasan Peneraju or the individuals involved in the transaction.

Corrupt practices involve the receiving, soliciting, offering, agreeing to, giving, directly or indirectly, anything of value (“gratification”) to improperly influence the actions of another party, through the abuse of power entrusted to the position held by such person.

The following are corruption offences that may be convicted under the Malaysian Anti-Corruption Commission (“MACC”) Act 2009:

1. Receiving or soliciting gratification (Sections 16(a) and 17(a));
2. Offering or giving gratification (Sections 16(b) and 17(b));
3. Making false claim (Section 18);
4. Using a public office or position for gratification (Section 23); and
5. Companies using gratification to obtain or retain business, or to secure an advantage in business (Section 17A).

Forms of corruption include bribery, kickbacks, facilitation payments, conflicts of interest, charitable donations and sponsorships, political donations, protection, cronyism, nepotism, external entertainment or hospitality, bid rigging, discounts, commissions, rent-seeking, false claims,and abuse of power.
